India: Arbitrary detentions and beatings in Jammu and Kashmir - new testimony

a clear pattern of the Indian authorities arbitrarily detaining activists, politicians and even children if they are thought to hold dissenting opinions, as the crackdown in Jammu and Kashmir continues. After conducting interviews in Jammu and Kashmir in the last six weeks, Amnesty International India is demanding the immediate release of all detainees held without charge or trial, and a complete lifting of the communication blockade in the region.
While some mobile networks have been restored, internet services remain unavailable in Jammu and Kashmir. Public transport continues to be off the roads, restricting access to the region. The communications blockade is also having an adverse effect on access to health care and freedom of the press in Jammu and Kashmir.
Amnesty has also recorded a pattern of the authorities using excessive force and intimidation. Almost every detained person interviewed by Amnesty described being beaten and threatened, with several of these cases amounting to torture or other cruel, inhuman and degrading treatment.
In some instances, people reported security forces ransacking their homes, intentionally damaging property and threatening families.
In most cases of people detained, lawyers and family members of the detainees are not informed of the grounds of arrests and the whereabouts of their clients and relatives. Refusal to share critical information with the detainees’ family members and lawyer constitutes a serious violation of the detainees’ right to a fair trial. It effectively prevents them from seeking an independent judicial review of the lawfulness of their detention.

“The cases documented by Amnesty International India clearly show the government’s witch-hunt to curb dissenting voices in Kashmir, including those of duly-elected leaders.
An atmosphere of fear and reprisal has ensured silence from many quarters. This has been compounded through arbitrary detentions.”

نئی دہلی،18اکتوبر : حقوق انسانی کی عالمی تنظیم ایمنسٹی انٹرنیشنل نے بھارتی حکام کی طرف سے حالیہ لاک ڈاؤن کے دوران شہریوں، سیاست دانوں اور یہاں تک کہ بچوں کو جبری حراست میں لینے کی واضح دستاویز ات پیش کی ہیں ۔
ساؤتھ ایشین وائر کے مطابق پچھلے چھ ہفتوں میں مقبوضہ کشمیر میں مختلف لوگوں سے بات چیت کرنے کے بعد ایمنسٹی انٹرنیشنل نے ایک رپورٹ تیار کی ہے اور بھارت سے مطالبہ کیا ہے کہ بغیر کسی الزام یا مقدمے کی گرفتاری کے تمام نظربندوں کو فوری رہاکیا جائے۔
ایمنسٹی انڈیا نے مقبوضہ کشمیرمیں 21 افراد سے انٹرویو کیا ، جن میں حراست میں لیے گئے افراد اور ان کے وکلا ، طبی پیشہ ور افراد ، مقامی صحافی اور سیاسی رہنما بھی شامل ہیں۔
ایمنسٹی انٹرنیشنل نے کہا ہے کہ اگرچہ کچھ موبائل نیٹ ورک کو بحال کردیا گیا ہے لیکن مقبوضہ جموں و کشمیر میں انٹرنیٹ سروسز دستیاب نہیں ہیں۔ عوام کی آمدورفت کے راستے بند رکھنے سے لوگ گھروں تک محدود ہیں اور مواصلات پر پابندی کا جموں و کشمیر میں صحت کی دیکھ بھال اور آزادی صحافت پر بھی برا اثر پڑ رہا ہے۔
ایمنسٹی انٹرنیشنل نے اپنی رپورٹ میں مقبوضہ کشمیر میں بے گناہ لوگوں پر وحشیانہ طاقت کے استعمال کی بھی نشاندہی کی ہے ۔ ایمنسٹی نے جن لوگوں سے بات چیت کی ، ان میں سے تقریبا ہر فرد کو مار پیٹ اور دھمکیوں کا نشانہ بنایا گیا ، ان میں سے بہت سے افراد کو شدید تشدد یا دیگر ظالمانہ ، غیر انسانی اور ہتک آمیز سلوک کا نشانہ بنایا گیا۔
ایمنیسٹی کو لوگوں نے یہ بھی بتایا کہ سیکیورٹی فورسز نے ان کے گھروں کو توڑ ا ، جان بوجھ کر املاک کو نقصان پہنچایا اورخاندان کے افراد کو دھمکیاں دیں۔
زیر حراست لوگوں کے بیشتر معاملات میں ، زیر حراست افراد کے وکیلوں اور خاندان کے افراد کو گرفتاری کی بنیاد اور ان کے موکلوں اور رشتہ داروں کے بارے میں نہیں بتایا جاتا ۔ زیر حراست افراد کے لواحقین اور وکیل کے ساتھ معلومات شیئر کرنے سے انکار ، قیدیوں کے حق کی سنگین خلاف ورزی ہے۔
